We appreciate that a positive result in the criminal prosecution can pay dividends when it comes to civil liability.

The investigations we carry out provide you with useful information in defending the claim. Ultimately our aim is to provide the best outcome for your insured and by doing so assist defending the civil claim.

We understand the requirements of Insurers and offer only a first class service for your insured providing them with support through this often difficult process.

What we can do for you and your insured

Our approach will be to:-

  • Quickly obtain the particulars of the third party driver, including injuries sustained, so that you can allocate the case to the correct department without delay.
  • Obtain all the prosecution evidence, including police plans, photographs, witness statements and the accident investigation report for free.
  • Keep you informed of all the hearing dates and decisions that are made.
  • Represent your insured at the police station interview. The police station interview is the first line of defence for any prosecution or claim, a positive interview and can alter the outcome of the case. We will always have briefed the insured beforehand, so that they fully understand their rights and do not disclose any information that may ultimately prejudice their case.
  • Investigate whether the third party driver caused the accident/or contributed to the accident. If so, we shall promptly inform you, so that you can defend the claim from the outset.
  • Obtain, if appropriate, an accident reconstruction report is required with your approval we shall first ask the expert to consider the evidence and provide a verbal report. Only if the expert can assist the case, will a full report be requested.
  • Attend the Coroner’s Inquests, which will provide a useful opportunity for us to gather any other evidence that may support the case for the defence. Just as importantly, our presence is vital to ensure that questioning from the family of the decease doesn’t take inappropriate directions that may prejudice our client’s case.
  • Focus all our energy on mitigation and endeavour to obtain the lowest sentence possible If a guilty plea is the only option or a defence is not viable.
  • In a successful case, recover our costs, as well as any disbursements, from the Court Central Funds Office.

These cases are often extremely stressful for defendants. We support them throughout the process, representing them at police interviews and working hard to secure a settlement without going to Court. If the case does go to Court, we will instruct experienced, specialist barristers we know will give your insured a first class service.

We operate some cases on a fixed fee basis (Click here to be taken to 'Our fees'), and always endeavour to keep our costs reasonable. For serious offences such as Manslaughter, Causing death by Dangerous Driving, and Careless Driving, we charge £120 + VAT per hour.
