Protecting the family:

If someone dies without leaving a will...

  • Your family will have no say to what happens to the assets - the state will decide.
  • Not all assets will automatically pass to the husband or wife.
  • There will be no choice of who will administer the estate.
  • Partners will not receive anything if you are not married, even if they live together and have children.
  • An estranged husband or wife could inherit all or part of your estate if you are separated but not divorced.
  • There will be no say over who will look after any children. The Court will decide and they may even be split up or placed with strangers.

Protecting your estate:

  • It is advisable to make a will if you own a poperty as this is a large asset.
  • With the continuing rise in house prices, the estate could become liable for Inheritance Tax.
  • Not all homemade wills are valid as they may not comply with the necessary requirements. This could force the estate into Court at extra expense.
  • If a person marries or divorces after making a will, it will no longer be valid.
